The European Union recently drafted a rule that will force ride-hailing apps such as Uber and Deliveroo to pay benefits to their drivers.

While the rule seeks to create a level playing field for technology companies in this area, it will also ensure that it is already part of the labor laws available for the creation of new models. According to the EU, the once adopted proposal is expected to reach around 4.1 million of the 28 million employees working for online platform companies in 27 countries.

To clarify, the EU proposal provides for companies to be considered employers when they implement a range of measures, including monitoring workers’ performance by electronic means, restricting workers’ choice of working time or tasks and, finally, prohibiting them from working for third parties.

Therefore, if there is a dispute as to whether an employee is a self-employed entrepreneur or employee, companies are obliged to provide evidence.
