New Jersey attorney sues Microsoft for $1.75M

June 28, 2023

A New Jersey attorney, David M. Schlachter is suing Microsoft for $1.75 million, claiming the company failed to fix a verification issue that has cut him off from his paid work email account.

Schlachter claims he lost access to his Microsoft business email account in May and that Microsoft has been unable to remedy the issue despite many attempts to contact customer service. Schlachter claims he attempted to log in to his account for the first time on May 10, but was requested for two-factor verification. He entered the right code but was subsequently locked out of his account, with the warning “Your account has been locked due to multiple failed sign-in attempts.”

Schlachter claims he has attempted several times to contact Microsoft customer service but has been unsuccessful. He also claims to have spent hours on hold, been moved to numerous departments, and been given contradictory information regarding the progress of his case.

Schlachter argues that his inability to use his email account has caused him substantial financial and professional difficulties. He has been unable to interact with clients, judges, and other professionals, resulting in appointments being canceled or postponed. He is also concerned about potential ethical infractions as a result of his inability to obtain critical case files.

Schlachter is suing for $750,000 in compensatory damages and $1 million in punitive penalties. The case is now pending in the Southern District of New York.
