{"id":42600,"date":"2023-11-01T14:31:10","date_gmt":"2023-11-01T18:31:10","guid":{"rendered":"https:\/\/www.itworldcanada.com?p=551177"},"modified":"2023-11-06T11:59:49","modified_gmt":"2023-11-06T16:59:49","slug":"proposed-canadian-privacy-law-is-like-a-leaky-bucket-balsillie-tells-parliamentary-committee","status":"publish","type":"post","link":"https:\/\/technewsday.com\/staging\/proposed-canadian-privacy-law-is-like-a-leaky-bucket-balsillie-tells-parliamentary-committee\/","title":{"rendered":"Proposed Canadian privacy law is like a leaky bucket, Balsillie tells parliamentary committee"},"content":{"rendered":"<p>Leaders of Canadian business associations expressed varying degrees of support for proposed privacy legislation reform before a parliamentary committee on Tuesday.<\/p>\n<p>But Jim Balsillie, former co-CEO of Research In Motion (now BlackBerry), told the House of Commons Industry Committee that the Consumer Privacy Protection Act (CPPA) needs a serious overhaul before being passed.<\/p>\n<p><span style=\"color: #333333;\">He complained the CPPA has <\/span><span style=\"color: #333333;\">\u201c<\/span><span style=\"color: #333333;\">a <\/span><span style=\"color: #333333;\">business interest carve-out<\/span><span style=\"color: #333333;\"> that allows corp<\/span><span style=\"color: #333333;\">oration<\/span><span style=\"color: #333333;\">s to put the pursuit of profits<\/span> <span style=\"color: #333333;\">above the interests of consumers. Bus<\/span><span style=\"color: #333333;\">inesses<\/span> are\u00a0<span style=\"color: #333333;\">allow<\/span><span style=\"color: #333333;\">ed to determine what constitutes legitima<\/span><span style=\"color: #333333;\">t<\/span><span style=\"color: #333333;\">e surveillance and behaviour modification <\/span><span style=\"color: #333333;\">to trample on fundamental rights<\/span><span style=\"color: #333333;\">, but<\/span><span style=\"color: #333333;\"> are<\/span><span style=\"color: #333333;\"> under no obligation to notify consumers how they are tracking and profiling them.<\/span><span style=\"color: #333333;\">\u201c<\/span><\/p>\n<p>Balsillie, who is founder of the <a href=\"https:\/\/www.centrefordigitalrights.org\/about\" rel=\"noopener\">Centre for Digital Rights<\/a>, also said the proposed Artificial Intelligence and Data Act (AIDA) should be scrapped.<\/p>\n<p><a href=\"https:\/\/www.itworldcanada.com\/article\/search-engines-social-media-platforms-to-come-under-canadas-ai-law-says-government\/548437\" rel=\"noopener\"><strong>Related content: The latest amendments to C-27<\/strong><\/a><\/p>\n<p><span style=\"color: #333333;\">T<\/span><span style=\"color: #333333;\">he two pieces of proposed legislation are combined under Bill <a href=\"https:\/\/www.parl.ca\/DocumentViewer\/en\/44-1\/bill\/C-27\/first-reading\" rel=\"noopener\">C-27<\/a>. Neither have <\/span><span style=\"color: #333333;\">much <\/span><span style=\"color: #333333;\">merit, Balsillie said.<\/span><span style=\"color: #333333;\"> In fact, he compared the CPPA to a leaky bucket. Proposing AIDA without proper public consultation is like the government putting on shoes and then trying to put on socks, he added.<\/span><\/p>\n<p><span style=\"color: #333333;\">\u201cC-27 turbocharges surveillance capitalism,\u201d he maintained.<\/span><\/p>\n<p><a href=\"https:\/\/www.itworldcanada.com\/article\/breaking-news-government-files-latest-attempt-at-privacy-legislation-reform\/488771\" rel=\"noopener\"><span style=\"color: #333333;\">The <\/span><span style=\"color: #333333;\">package of bills<\/span>\u00a0<\/a><span style=\"color: #333333;\">\u201c<\/span><span style=\"color: #333333;\">prioritizes <\/span><span style=\"color: #333333;\">the interests of large <\/span><span style=\"color: #333333;\">data monopoli<\/span><span style=\"color: #333333;\">e<\/span><span style=\"color: #333333;\">s<\/span><span style=\"color: #333333;\"> and their ecosystem of [data] traffickers. It sets a <\/span><span style=\"color: #333333;\">dangerous precedent<\/span><span style=\"color: #333333;\"> by allowing corp<\/span><span style=\"color: #333333;\">oration<\/span><span style=\"color: #333333;\">s to allocate to individuals, children and vulnerable gr<\/span><span style=\"color: #333333;\">o<\/span><span style=\"color: #333333;\">ups the harmful economic, political, and social consequences of the data<\/span><span style=\"color: #333333;\">\u2013<\/span><span style=\"color: #333333;\">driven economy. It<\/span><span style=\"color: #333333;\"> normalizes and expands surveillance<\/span><span style=\"color: #333333;\">, treating human rights as an obstacle to corporate profits. C-27 requires a wholesale re-do.\u201d<\/span><\/p>\n<p><span style=\"color: #333333;\">Liberal MP <\/span><span style=\"color: #333333;\">Francesco <\/span><span style=\"color: #333333;\">Sorbara <\/span><span style=\"color: #333333;\">asked<\/span><span style=\"color: #333333;\"> Balsillie if the CPPA, which <\/span><span style=\"color: #333333;\">would replace <\/span><span style=\"color: #333333;\">the Personal Information Protection and Electronic Data Act (PIPEDA) that <\/span><span style=\"color: #333333;\">many businesses now have to deal with, <\/span><span style=\"color: #333333;\">is <\/span><span style=\"color: #333333;\">at least <\/span><span style=\"color: #333333;\">going in the right direction. <\/span><\/p>\n<p><span style=\"color: #333333;\">\u201cI<\/span><span style=\"color: #333333;\">t<\/span><span style=\"color: #333333;\">\u2018<\/span><span style=\"color: #333333;\">s like saying my bucket has 25 holes and that<\/span><span style=\"color: #333333;\">\u2018<\/span><span style=\"color: #333333;\">s better than 30 holes<\/span><span style=\"color: #333333;\">,\u201d replied Balsillie. \u201cIf we get rid of 20 of the holes so we only have 10 left <\/span><span style=\"color: #333333;\">\u2026.<\/span> <span style=\"color: #333333;\">I think the nature of <\/span><span style=\"color: #333333;\">the digital <\/span><span style=\"color: #333333;\">and knowledge <\/span><span style=\"color: #333333;\">economy is non<\/span><span style=\"color: #333333;\">\u2013<\/span><span style=\"color: #333333;\">linear<\/span><span style=\"color: #333333;\"> in its harms<\/span><span style=\"color: #333333;\"> for imperfection<\/span><span style=\"color: #333333;\">. It<\/span><span style=\"color: #333333;\"> takes a small hole to drive a truck through<\/span><span style=\"color: #333333;\">. You need relative completeness<\/span><span style=\"color: #333333;\"> [in laws]<\/span><span style=\"color: #333333;\">, or somebody will escape through a small hatch.\u201d<\/span><\/p>\n<p><span style=\"color: #333333;\">If we\u2019re getting rid of 20 of 25 holes, at least we\u2019re making progress, Sorbara countered.<\/span><\/p>\n<p><span style=\"color: #333333;\">\u201cBut you still have five holes in your bucket \u2014 and it\u2019s not a bucket,\u201d replied Balsillie. \u201cIt has to be complete.\u201d The CPPA can only be fixed with<\/span><span style=\"color: #333333;\"> comprehensive changes, he maintained, not by patching its holes.<\/span><\/p>\n<p><a href=\"https:\/\/www.itworldcanada.com\/article\/fundamental-privacy-rights-of-canadian-should-trump-business-rights-in-conflicts-says-ex-privacy-czar\/550756\" rel=\"noopener\"><strong>Related content: Former privacy commissioner testifies<\/strong><\/a><\/p>\n<p><span style=\"color: #333333;\">Businesses have been thinking about preparing for the two pieces of legislation since they were introduced in Parliament over a year ago. They know that some form of overhauling of PIPEDA is necessary, in part because it may be declared offside of the European Union\u2019s General Data Protection Regulation (GDPR).<\/span><\/p>\n<p><span style=\"color: #333333;\">As for AIDA, around the world, governments are looking at possible legislation because people are worried that advanced AI systems may make their jobs obsolete<\/span><span style=\"color: #333333;\">, or deny them jobs<\/span><span style=\"color: #333333;\">. As a result, business leaders want some sort of law \u2014 but one that doesn\u2019t stifle new technologies. <\/span><\/p>\n<p><span style=\"color: #333333;\">A<\/span><span style=\"color: #333333;\">mong <\/span><span style=\"color: #333333;\">Balsillie\u2019s<\/span><span style=\"color: #333333;\"> complaints:<\/span><\/p>\n<p><span style=\"color: #333333;\">\u2014 the CPPA says in some cases businesses don\u2019t have to notify people how their personal data is being <\/span><span style=\"color: #333333;\">collected or <\/span><span style=\"color: #333333;\">used. <\/span><span style=\"color: #333333;\">That gives businesses too much power, Balsillie said;<\/span><\/p>\n<p><span style=\"color: #333333;\">\u2014 the CPPA also diminishes the protection of data of children and vulnerable persons, he said. \u201cT<\/span><span style=\"color: #333333;\">he omission of meaningful measures that curtail insidious surveillance and behavioural manipulation practices<\/span><span style=\"color: #333333;\"> \u2026<\/span><span style=\"color: #333333;\"> are driving the current youth mental health crisis<\/span><span style=\"color: #333333;\">.<\/span><span style=\"color: #333333;\">\u201c<\/span><\/p>\n<p><span style=\"color: #333333;\">\u2013<\/span><span style=\"color: #333333;\">\u2013 AIDA creates an AI commissioner to oversee the act, but that person will report to the Minister of Innovation and not be an independent officer who reports to Parliament;<\/span><\/p>\n<p><span style=\"color: #333333;\">\u2014 AIDA also doesn\u2019t give the right to individuals to<\/span><span style=\"color: #333333;\"> contest A<\/span><span style=\"color: #333333;\">I-based<\/span><span style=\"color: #333333;\"> decisions <\/span><span style=\"color: #333333;\">of businesses on the granting of insurance, or credit scoring, or education institutions on <\/span><span style=\"color: #333333;\">school admissions<\/span><span style=\"color: #333333;\">.<\/span><\/p>\n<p><span style=\"color: #333333;\">He got some support on scrapping AIDA from Siobh\u00e1n Vipond, <\/span><span style=\"color: #333333;\">e<\/span><span style=\"color: #333333;\">xecutive <\/span><span style=\"color: #333333;\">v<\/span><span style=\"color: #333333;\">ice-<\/span><span style=\"color: #333333;\">p<\/span><span style=\"color: #333333;\">reside<\/span><span style=\"color: #333333;\">nt<\/span><span style=\"color: #333333;\"> of the <a href=\"https:\/\/canadianlabour.ca\/\" rel=\"noopener\">Canadian Labour Congress<\/a>, who complained the proposed legislation hasn\u2019t had a full public consultation,<\/span><span style=\"color: #333333;\"> and it wouldn\u2019t apply to the federal government<\/span><span style=\"color: #333333;\"> and Crown corporations. <\/span><span style=\"color: #333333;\">That means it wouldn\u2019t protect<\/span><span style=\"color: #333333;\"> public <\/span><span style=\"color: #333333;\">servants, she said. <\/span><\/p>\n<p><span style=\"color: #333333;\">On the other hand, <\/span><span style=\"color: #333333;\">S<\/span><span style=\"color: #333333;\">ara Clodman,<\/span><span style=\"color: #333333;\"> v<\/span><span style=\"color: #333333;\">ice <\/span><span style=\"color: #333333;\">p<\/span><span style=\"color: #333333;\">resident, <\/span><span style=\"color: #333333;\">p<\/span><span style=\"color: #333333;\">ublic <\/span><span style=\"color: #333333;\">a<\/span><span style=\"color: #333333;\">ffairs and <\/span><span style=\"color: #333333;\">t<\/span><span style=\"color: #333333;\">hought <\/span><span style=\"color: #333333;\">l<\/span><span style=\"color: #333333;\">eadersh<\/span><span style=\"color: #333333;\">ip<\/span><span style=\"color: #333333;\"> at the <a href=\"https:\/\/thecma.ca\/\" rel=\"noopener\">Canadian Marketing Association<\/a>, urged speedy adoption of the CPPA with what she called \u201climited amendments.\u201d<\/span><\/p>\n<p>Similarly, Lorraine Krugel, vice president for privacy and data at the Canadian Bankers Association, asked for \u201ctargeted amendments\u201d to the CPPA.<\/p>\n<p><span style=\"color: #333333;\">\u201cWe are <\/span><span style=\"color: #333333;\">concerned <\/span><span style=\"color: #333333;\">there\u2019s a <\/span><span style=\"color: #333333;\">real risk<\/span><span style=\"color: #333333;\"> of significant adverse consequences<\/span> <span style=\"color: #333333;\">i<\/span><span style=\"color: #333333;\">f <\/span><span style=\"color: #333333;\">the <\/span><span style=\"color: #333333;\">sc<\/span><span style=\"color: #333333;\">o<\/span><span style=\"color: #333333;\">pe <\/span><span style=\"color: #333333;\">of certain provisions are not better defined and necessary exceptions aren\u2019t included,\u201d she said. \u201cWe want to avoid situations where organizations have <\/span><span style=\"color: #333333;\">to give too much infor<\/span><span style=\"color: #333333;\">mation to be transparent to customers [as required by the CPPA]. For example, some things may result in online customers having <\/span><span style=\"color: #333333;\"> \u2018consent fatigue\u2019<\/span><span style=\"color: #333333;\"> or \u2018cookie banner fatigue\u201d with no meaningful value to the consumer.\u201d<\/span><\/p>\n<p>Catherine Fortin LeFaivre, the <a href=\"https:\/\/chamber.ca\/\" rel=\"noopener\">Canadian Chamber of Commerce\u2019s<\/a> vice-president of strategic policy and global partnerships, said the CPPA should be passed as soon as possible. But she also agreed AIDA needs more public consultation.<\/p>\n<p>The committee has grouped witnesses who largely want to comment on the CPPA to be heard first. Later, those who want to speak specifically about AIDA will be called.
